This Privacy Policy explains how Darkspeed Consulting LLC ("Darkspeed," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit darkspeedconsulting.com, contact us, work with us as a client, or use any product or service we operate that refers to this policy (the "Services").

LoreWeaver. Darkspeed operates LoreWeaver and LoreWeaver AI, which are brands of Darkspeed Consulting LLC. Darkspeed Consulting LLC is the business responsible for personal information collected through LoreWeaver. LoreWeaver has its own Privacy Policy at loreweaverai.com/privacy, which describes that product's practices in detail and controls where it differs from this policy.

Client data. When we process personal information on behalf of a client under a services agreement, we act as that client's service provider or processor. The client's privacy notice and our agreement with the client govern that information, and questions about it should go to the client.

Information you give us. Contact details such as your name, email address, phone number, and company; the content of your messages; account information; project materials and requirements you share with us as a client; payment and billing details; and any content you submit through the Services.

Information collected automatically. Device and usage information such as your IP address, approximate location derived from it, browser and device type, pages viewed, referring pages, and the dates and times of your visits, collected through server logs, cookies, and similar technologies.

Information from others. Information from sign-in providers you choose to use, payment processors, app stores, business partners, and publicly available sources.

We do not knowingly collect sensitive personal information, and we ask that you not send it to us unless a Service clearly requires it. Payment card numbers are handled by our payment processors and are not stored on our systems.

We use personal information to:

• Provide, operate, maintain, and support the Services, and perform our agreements with you and with clients
• Create and manage accounts, process payments, and send receipts and service messages
• Respond to inquiries and communicate with you, including, where permitted, about our products and services
• Protect the security and integrity of the Services, prevent fraud and abuse, and enforce our terms
• Understand how the Services are used, fix problems, and improve and develop our products
• Comply with legal obligations, respond to lawful requests, and establish, exercise, or defend legal claims
• Carry out any other purpose with your consent

You can opt out of marketing emails at any time with the unsubscribe link in them or by contacting us. Service messages, such as receipts and security notices, are not marketing.

Where a Service includes AI features, the content you submit may be sent to third-party AI model providers so they can generate a response. These providers process that content under their agreements with us and their own terms and policies. We do not use the personal information covered by this policy to train generative AI models. Product privacy policies, such as LoreWeaver's, describe their AI processing in more detail.

We disclose personal information only as follows:

• To service providers that work on our behalf, such as hosting and cloud infrastructure, databases, authentication, payment processing, email delivery, analytics, error monitoring, and AI model providers, under contracts that limit their use of it
• To professional advisers, such as lawyers, accountants, and insurers, under duties of confidentiality
• When required by law or legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of Darkspeed, our users, or others
• In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to this policy's protections
• With your consent or at your direction, such as when you choose to publish content to others

We may also share information that has been aggregated or de-identified so it can no longer reasonably identify you.

We do not sell personal information, and we do not share it for cross-context behavioral advertising or use it for targeted advertising, as those terms are defined under U.S. state privacy laws. We do not use personal information for profiling that produces legal or similarly significant effects.

We use cookies and similar technologies that are necessary to run the Services, keep you signed in, remember your preferences, keep the Services secure, and measure performance. We do not use advertising cookies. You can control cookies through your browser settings, though some features may not work without them. Our websites do not respond to Do Not Track signals, but we honor Global Privacy Control signals as a request to opt out where the law requires.

We keep personal information only as long as needed for the purposes described in this policy, including to provide the Services, meet our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When we no longer need it, we delete it or de-identify it.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affects your personal information, we will notify you and the authorities as required by law.

Darkspeed is based in the United States, and we and our service providers process personal information in the United States and other countries whose laws may differ from those where you live. Where required, we use appropriate safeguards, such as the European Commission's Standard Contractual Clauses, for transfers of personal information out of the European Economic Area, the United Kingdom, and Switzerland.

Depending on where you live, you may have the right to:

• Know or access the personal information we hold about you and how we use and disclose it
• Correct inaccurate personal information
• Delete personal information
• Receive a portable copy of personal information
• Opt out of the sale of personal information, targeted advertising, and certain profiling, none of which we engage in
• Withdraw consent where we rely on it, and object to or restrict certain processing

U.S. residents. Residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other states with privacy laws may exercise the rights their state provides. We will not discriminate against you for exercising them. You may use an authorized agent, and we may ask the agent for proof of authorization.

California. In the past 12 months we collected the categories of personal information described above: identifiers, commercial information, internet or network activity, approximate geolocation, professional information, and content you provide. We collected it from the sources and for the purposes described in this policy, and disclosed it for business purposes to the categories of recipients described above. We have not sold or shared personal information as those terms are defined by the California Consumer Privacy Act.

EEA, UK, and Swiss residents. We process personal information on the following legal bases: to perform a contract with you, for our legitimate interests in operating, securing, and improving the Services, to comply with legal obligations, and with your consent. You may also lodge a complaint with your local data protection authority.

How to make a request. Email connect@darkspeedconsulting.com with the subject "Privacy request." We will verify your identity before acting, which may require you to confirm information we already hold, and we will respond within the time the law requires, generally 45 days. If we decline your request, you may appeal by replying to our decision with the subject "Appeal." If we deny your appeal and you live in Virginia, you may contact the Virginia Attorney General.

The Services are intended for adults and are not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.

The Services may link to websites and services operated by others. Their privacy practices are governed by their own policies, and we are not responsible for them.

We may update this policy from time to time. We will post the updated policy with a new effective date and, if the changes are material, give reasonable notice, such as by email or in the Services.
